Understanding Domestic Violence under Colorado Law

 In Colorado, domestic violence refers to any act or threatened act of violence against someone with whom the offender has or had an intimate relationship. This can include spouses, ex-spouses, dating partners, co-parents, or household members.


Domestic violence may also include crimes such as:


  • Physical assault or harassment
     
  • Threats, intimidation, or emotional abuse

Colorado law treats domestic violence very seriously. Victims have access to strong legal protections designed to provide safety and prevent further harm.

Legal Protections Available in Colorado

 If you or your children are in danger, you can ask the court for a Protection Order, also known as a Restraining Order. These court orders restrict or prohibit contact between the accused individual and the victim.


There are three main types of protection orders in Colorado:


  1. Emergency Protection Orders (EPO): Issued by law enforcement and valid for up to three days when immediate danger exists.
     
  2. Temporary Protection Orders (TPO): Granted by a judge and typically last up to 14 days, until a full hearing is held.
     
  3. Permanent Protection Orders (PPO): Issued after a hearing if the court determines ongoing protection is necessary.
     

Protection orders can require the restrained person to:


  • Stay away from your home, workplace, or children’s school
     
  • Cease all contact (calls, messages, social media, etc.)
     
  • Surrender firearms or weapons
     
  • Vacate a shared residence
     

If a protection order is violated, law enforcement can make an immediate arrest.
